Your pool company had started their excavation and we noticed that all of the foundations on the right side were exposed, compromising the integrity of your fence between you and your neighbour. All of your posts are dug at 3 to 3 1/2 feet and we cement all of our posts and bell our bottoms. The damaged U channel that was used for change of directions is fractured and was causes by the stress of the line. The pickets are held by the top and bottom rails. In your case the damage to your fence is not covered under our installation warranty. This is not an installation issue and will not be repairing your fence under warranty as our policies clearly outlined on our website "Any alterations to the landscaping either by the homeowner or your neighbours which affect the fence will void all warranties. e.g. final grading, change of elevation etc"

Unfortunately, in this case the client has chosen to ignore her contractual obligation which is clearly outlined in her contract. Also, in this case her financial amount owing did not change. We are still waiting for our final payment.
Read your contract, hard digging is subject to charges. Also, your contract stipulated that payment is due upon completion. You are incorrect in regards to the 10% of the total cost. As for the legal dispute with your neighbours you should ask them directly.
We installed their fence on the right side of their property in 2020. Their plan was to install a pool in the Spring of 2021, they contracted us again for the fence located on the left side of their property while their pool was being installed. They also had a wrought iron fence gate installed. The landscape/pool company removed the wrought iron fence and unfortunately did a poor job re-installing the gate, there where parts missing and caps. We also noticed while we were there that the excavation for the pool on the right side of the property we can see that the foundations where exposed. We have addressed her fence issues. Our contract is 50 percent deposit and balance upon completion. Once, the homeowner and the neighbour made alterations to the landscaping, final grading, change of elevation any adjustment to the fence should be subject to charges. Any defect in material should be directed to the manufacturers warranty and will be subject to charges to install the defective part.

Further to the complaint, this project was initiated by the neighbour as they had a survey done on their property and their findings were that there was encroachment onto their property. The day of the measurement there were many obstacles to overcome both with measurement and personalities. He was displeased in regards to the changes to his backyard and cost incurred. The initial family that contacted us made is worthwhile for us to proceed. They were pleasant from the beginning to the end to the point where they are scheduling a project with us next season.
