Off The Wall Install

I contracted Dan From Off the Wall Install in July 2019 for removal and installation of tiles in our kitchen. He was recommended to us by a friend. He started the work on time but finished a few days late. He always seemed very rushed and often left to do another job nearby, leaving his workers to do the work. We were concerned about this but he assured us they were just doing the demo and he would be doing the tile installation. When the job was completed we immediately noticed problems. Not only were a number of tiles installed unevenly, soon after he completed the work, the tiles in the kitchen began to shift. So far, grout has cracked around 30 tiles and a few tiles have completely lifted. After unsuccessfully trying to repair the tiles three times, Dan agreed to refund a third of the amount so I could hire someone else to redo the kitchen. I fully intended to move on once I received the refund but he stopped responding to my texts/emails and did not refund the money. My lawyer contacted him and advised him that he was in breach of contractual obligations and we were willing to accept the amount he offered as full and final settlement. In early November, Dan admitted fault to our lawyer (in writing) and promised that the cheque was in the mail. To this date, we have not received payment and out tiles just keep getting worse. We have two years from date of complaint to commence with legal proceedings but in the meantime I felt it was important for others who may be thinking of hiring Dan to know what our experience has been. He does not stand behind his work. Ultimately, he failed to do the work properly and honour his commitment. This has been the nightmare I worried about when hiring a contractor.
