First let me say their website www.mrtankless.ca resolves to a government Consumer Complaint Form. Wonder why... In 2009, we got a tankless water heater installed with them and actually their company name is Active Temp Control. The deal was good. Price was 29$ tax-in (rent-to-own) and we were able to cancel, transfer or buyout any time. Was written in writing on the contract. No problems with them, the install and system, until we moved. 6 months after the move, in early 2010 we were served with court papers on breach of contract and failure to pay the monthly amount owed from the start. Before the move, although we could have simply canceled the contract and have them remove it (was in writing), we were asked by them to reach out to the new home owner and see if he wanted to take over the payments. So good people we are, we went to the trouble of coordinating the transfer for them to do the paper work. Contractually, all was legal and no liens whatsoever. In fact, at house closing, my lawyer made sure this was not an issue and we were good. So back to the court case... so naturally, we filed a defense claim and countersuit with a tonne of evidence including our original contract, the new home owner's contract, sworn statement by the home owner, our payment evidence, etc. Active Temp Control had no evidence attached to their submission other than all the false claims because they had none! Needless to say, they never showed up at the preliminary court hearing and were fined 300$ to pay to us for wasting ours and the courts time. Of course, they never paid the 300$ for which by default, their case then became dismissed. The frustrating thing here is the court costs we lost (about 170$) but most importantly, the aggravation, stress, and time lost they inflicted upon myself and family. They are by far the most scandalous business I have ever dealt with and seeing a complaint form coming up on the website gives me a sense of vindication.
